These Terms and Conditions (“Terms”) govern the use of services, facilities, and offerings provided by Body Innovation, including biokinetics sessions, group classes, and recovery treatments. By engaging with Body Innovation, clients confirm their agreement to these Terms. If you do not agree to these Terms, you may not use our services.
Definitions
- “Body Innovation” refers to Body Innovation (Pty) Ltd – registration number: 2016/382945/07; practice number: 0910000251623.
- “Client” refers to any individual making use of Body Innovation’s services or facilities.
- “Services” refer to all offerings provided by Body Innovation, including group classes, private and duo biokinetics sessions, recovery treatments, and any other related activities.
- “Facility” refers to Body Innovation’s premises at 330 Oklahoma Road, Faerie Glen, Pretoria, 0081, South Africa or Planet Fitness at Lynnwood Bridge, Lynnwood Manor, Pretoria, 0081.
Services
Body Innovation provides the following services:
- Biokinetics services:
- Private biokinetics sessions, available at Body Innovation’s private rates or medical aid rates.
- Duo biokinetics sessions for two participants sharing one session.
- Group training/classes:
Structured group training sessions aimed at achieving specific fitness or rehabilitation goals. Body Innovation reserves the right to cancel group classes if only one participant is booked. - Recovery treatments:
Services designed to enhance recovery, mobility, and overall well-being. - Additional services:
Other offerings may be introduced by Body Innovation from time to time.
All services are subject to availability, and bookings must adhere to the procedures outlined below. Body Innovation reserves the right to adjust service offerings at its discretion.
Payment terms
- All payments must be made in advance of any session or service.
- Bookings will only be confirmed upon receipt of payment.
- Body Innovation reserves the right to recover unpaid amounts, including attorney and client costs, collection commission, tracing fees, and interest on overdue accounts, as permitted under South African law.
Cancellation policy
- Appointments cancelled less than 12 hours before the scheduled time will incur a cancellation fee.
- Appointments canceled less than 4 hours before the scheduled time will be charged in full.
- If there is only one participant booked for a group class, Body Innovation reserves the right to cancel the class and will notify the participant.
Indemnity and limitation of liability
- Clients indemnify and hold Body Innovation, its employees, agents, and affiliates harmless from any and all claims, demands, damages, costs, and liabilities arising from:
- Loss, injury, or damage sustained during participation in services or use of facilities.
- Negligence on the part of the client or third parties.
- Body Innovation shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising out of the use of its services or facilities, except where such loss or damage is due to gross negligence or willful misconduct by Body Innovation.
- Participation in services is at the client’s own risk, and clients must disclose any medical or health-related conditions before participation.
Facility usage and marketing consent
- Body Innovation reserves the right to use photos and videos of its facilities and clients for marketing and promotional purposes, including on social media.
- By using the facilities, clients consent to the possible inclusion of their likeness in such media unless explicitly stated otherwise in writing.
Booking procedure
- Private sessions may be booked telephonically, via email, or in person.
- Group training bookings must be made online at least 4 hours in advance.
Force majeure
Body Innovation will not be held liable for failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, lockdowns, or governmental restrictions.
No cession
Clients may not cede, delegate, or assign any of their rights or obligations under these Terms without the prior written consent of Body Innovation.
Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, such provision shall be severed, and the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
Applicable legislation
These Terms shall be interpreted and governed in accordance with the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act and the Protection of Personal Information Act (POPIA).
Governing law
Disputes arising from these Terms shall be governed by South African law. Disputes will first be referred to mediation, failing which they will be resolved in South African courts.
Acknowledgment and acceptance of terms
By engaging with Body Innovation’s services or becoming a client, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions in their entirety.
